High Court on Thursday cancelled the case of sexual harassment against Jose Thettayil MLA. The court's verdict has come in response to an appeal by Thettayil seeking cancellation of the FIR of sexual abuse registered against him.
The court in its ruling observed that no offence of sexual violence stands against Thettayil and the complainant has not been able to produce any concrete evidence to prove any sexual violence meted out against her. The court dismissed the complainant's argument that the physical relation had occurred without her consent.
The court also said the statement the woman gave to the investigation team was also weak. The video clip that the woman had submitted cannot be considered as a strong evidence.
Meanwhile Thettayil had argued that the complaint of the woman itself clearly showed that they had mutually consented sexual relation.
However, the prosecution had argued that though rape charges doesn't stand against Thettayil a case of insulting womanhood would remain.
